This section provides information on the federal (Commonwealth) industrial relations system.
Industrial relations legislation has a predominantly federal emphasis since the federal Government ‘took over’ the regulation of industrial relations for corporations in Australia from the States in 2006.
More recently, complimentary federal and state legislation further extends federal coverage to non-incorporated private employers with effect from 1 January 2010. This is discussed under the various state legislative commentaries.
The Fair Work Act 2009 has replaced the legislation colloquially known as ‘WorkChoices’ legislation — effective from 1 July 2009 in most respects, except in relation to modern awards and the National Employment Standards which commenced on 1 January 2010.
