The Employment Advocate has instituted proceedings in the Australian Industrial Relations Commission to have preference clauses removed from certified agreements.

Recent amendments to the Workplace Relations Act 1996allow the Employment Advocate to apply to the Commission to have preference clauses removed from certified agreements.

There are currently over 1000 certified agreements containing void preference clauses. Despite the fact that these clauses are unenforceable, their presence in certified agreements could lead people to inadvertently break the law.

This power complements the Employment Advocate’s power to investigate breaches of the Act’s freedom of association provisions.
