Revised documentation relating to enterprise bargaining in WA has been released this month.

The provisions for Employer-Employee Agreements in the Industrial Relations Act 1979, were proclaimed in the Government Gazette No. 160, Friday 6 September 2002 and came into effect on 15 September 2002.

The Guidelines and Principles document

addresses an important question in relation to enterprise agreements: what is the relevant or comparable award or order to which the provisions of the agreement will be compared? This key question confronted by parties when drafting an enterprise agreement can be expressed as whether the 'No Disadvantage Test' has been met. This means that the relevant/comparable award needs to be compared to the proposed agreement. The guidelines provide information on how this comparison can be conducted.
