FWC awards review focuses on annual leave

The Fair Work Commission is continuing its review of modern awards, with annual leave provisions now in the limelight.

The annual leave proceedings are ongoing with another hearing scheduled for 1 December 2014 to deal with employer claims concerning annual close down and the granting of leave in advance; and the ACTU claim relating to guaranteeing the payment of annual leave loading on termination.

Standard provisions?


The Fair Work Commission has raised the possibility of ‘standard provisions’ across all awards.

Employers are arguing that common conditions are not appropriate for all awards. They claim uniformity and simplicity are distinct concepts and that in industries where current provisions are working, achieving a uniform standard will not deliver simplicity if it changes the existing state of affairs.

The  joint employer application is seeking “to ensure a sufficient level of flexibility by bringing awards up to a minimum standard”.
