Push to turf penalty rate lingo could impact all awards

Peak bodies in the Australian tourism industry have applied to remove the reference to “penalty” and “penalty rates” in the Hospitality Industry Award.

FWC president Justice Iain Ross said if the hoteliers’ changes were accepted, then, at first sight, the changes should be made in all modern awards that currently provide for penalty rates. 

The rationale for the change is that it is written in the Fair Work Act (s134) of “the need to provide additional remuneration for… employees working on weekends”.

Justice Ross said the proposed changes were consistent with the purpose of “penalty rates”. 

The Fair Work Commission is calling for submissions in writing on or before 8 May.
