On Wednesday, 27 March 1996, the Full Bench of the Industrial Relations Commission of NSW considered the question of whether the third arbitrated safety net adjustment (‘ASNA’) should continue to be available, as it had earlier decided in December 1994.

The Bench’s decision, which is expected in the near future, will confirm important issues such as timing and the date of the operation of the third safety net adjustment.

The decision is also expected to bring the payment of work related allowances for the second and third ASNA into line with the federal practices. It is likely that the decision will allow unions to apply for the third ASNA on an award by award basis, but subject to certain conditions being satisfied.
