Earlier this year, the ACT Legislative Assembly enacted the Discrimination Amendment Act 2003, changing the Discrimination Act 1991 in four areas.

With the amendments, the Act now:

  • provides for equal treatment of same-sex partnerships,
  • protects people from discrimination on the basis of a possible future disability,
  • in certain circumstances allows employers to terminate the employment of a person whose disability means they can no longer do their job, and
  • strengthens conciliated agreements by making them enforceable as decisions of the Discrimination Tribunal.
