The Fair Work Principles User Guide provides more details on the obligations that the Fair Work Principles impose on tenderers.
 
The model dispute resolution term in the Fair Work Regulations empowers FWA to make a binding determination in relation to disputes, and this is central to the approach preferred by the Federal Government.
 
Disclosure
 
The guide provides further details on the requirement in the Fair Work principles for potential suppliers to advise the tendering agency of any adverse court or tribunal decisions against it for breach of workplace relations, OHS or workers compensation law in the last two years. If a tenderer fails to meet the disclosure requirement, their tender can be excluded from submission.
 
Contractors to the Federal Government need to pay particular attention to the principles. Contractors are also obliged to require subcontractors performing work to comply with the Fair Work principles as far as practicable.
 
A number of model statements and clauses are set out in the guide, including a statutory declaration of compliance with the principles and clauses and a form for detailing past breaches of industrial laws.
