Employment-related legislation listed for introduction (and in some cases, passage) is noted below.

Bills marked with an asterisk (*) are proposed for introduction and passage in the Winter sittings.

Higher Education Legislation Amendment (Demand Driven System) Bill * 
  • to implement the government’s commitment to a student demand driven system for undergraduate places at public universities and the abolition of the Student Learning Entitlement from 2012
Reason for legislation: to implement an election commitment and 2009–10 Budget measure.

Building and Construction Industry Improvement Amendment (Transition to Fair Work) Bill
  • to abolish the Australian Building and Construction Commission (ABCC) and create a new agency, the Office of the Fair Work Building Industry Inspectorate
  • to remove a range of industry specific regulation, including laws that provide higher penalties for breaches of industrial laws and broader circumstances under which industrial action attracts penalties
  • to introduce safeguards in relation to the use of the power to compulsorily obtain information or documents
Reason for legislation: to implement the government’s commitment to abolish the ABCC and to transfer its responsibilities to a specialist Fair Work Inspectorate.

Coal Mining Industry (Long Service Leave Funding) Legislation Amendment Bill 
  • amend the coal mining industry long service leave funding scheme to embody the current award-based long service leave entitlement into Commonwealth legislation, facilitate changes to employer reimbursement arrangements and the basis on which the levy is imposed, improve compliance and restructure the Board.
Reason for legislation: to give effect to a commitment given to stakeholders.

Fair Entitlements Guarantee Bill
  • establish the Fair Entitlements Guarantee to replace the existing administrative General Employee Entitlements and Redundancy Scheme
Reason for legislation: to implement an election commitment.

Indigenous Education (Targeted Assistance) Amendment Bill 
  • amend the Indigenous Education (Targeted Assistance) Act 2000 to extend the current funding quadrennium (2009–2012) by one year to 2013. This extension will realign this quadrennial legislation with the parallel legislation of the Schools Assistance Act 2008.
Reason for legislation: to bring the funding arrangements for the Indigenous Education (Targeted Assistance) Act 2000 in line with the funding arrangements under the Schools Assistance Act 2008.

Work Health and Safety Bill 
  • give effect in the Commonwealth jurisdiction to nationally harmonised model occupational health and safety provisions as agreed by the Workplace Relations Ministers’ Council.
Reason for legislation: to implement the COAG Inter-Governmental Agreement for Regulatory and Operational Reform in Occupational Health and Safety.
