The Federal Workplace Death and Serious Injury Bill 2003

will be introduced into Parliament by The Australian Greens MP Michael Organ in the first week of November 2003.

 

Organ, the Federal Member for Cunningham, released a draft of the proposed laws last month.

He said he had an ‘overwhelmingly positive response’ from unions and victims families.

Organ said national occupational health and safety statistics released yesterday, revealing that more people died at work than on the roads, were ‘shocking’.

‘My legislation is designed to improve workplace safety by providing prison terms of up to 25 years and fines up to $50 million for negligent employers if workers are killed or suffer serious harm at work,’ he said.

’Negligent employers have escaped serious penalty for too long, and measures to strengthen the onus on them to ensure a safe working environment are long overdue.

’My Bill will provide a significant range of penalties, including sentencing options, heavy fines, bans for company directors and provision for reparation.’

More specifically, the Criminal Code Amendment (Workplace Death and Serious Injury) Bill 2003 would provide for the following: 

  • up to 25 years imprisonment for executives found responsible for the death of an employee;
  • up to 10 years imprisonment for executives found responsible for seriously injuring an employee;
  • up to $5 million in fines for executives found responsible for the death of or seriously injuring an employee;
  • up to $50 million in fines for corporations found responsible for the death of or seriously injuring an employee;
  • bans on individuals being company directors;
  • community service obligations;
  • monetary or other reparation; and
  • range of other sentencing options.
