Redacted versions of registered enterprise agreements that have been assessed by Fair Work Building Construction Commission as compliant with the Building Code 2013 can now be viewed on the FWBC website.

In making this information available, the FWBC said it "aims to assist building industry participants who are currently considering enterprise agreements and wish to ensure they remain eligible to tender for Commonwealth funded building work”.

Background


On 13 May 2016 it was announced that FWBC would be responsible for assessing all enterprise agreements made on or after 18 May 2016 for compliance with the Building Code 2013.

Contractors who made or varied an enterprise agreement on or after this date would require an FWBC letter of compliance if they wanted to express interest in or tender for future Commonwealth funded building work.

Contractors covered by enterprise agreements that FWBC assessed as inconsistent with the Building Code 2013 are ineligible to express interest in or tender for future Commonwealth funded building work.

Activities


Since taking over responsibility for assessing enterprise agreements against the Building Code 2013, FWBC has:

  • received 156 requests to provide feedback on draft agreements
  • assessed 93 draft agreements (some agreements submitted in revised form)
  • assessed 30 draft agreements as compliant
  • received 51 FWC registered enterprise agreements for formal assessment
  • issued 11 letters of compliance for FWC registered agreements
  • deemed compliant 88 workplace arrangements that were either modern awards or agreements made prior to May 18.
