IR changes pending — state of play

The election of the Labor Government in 2007 has resulted in the prospect of considerable change on the IR front. Most of the changes have not come into effect. Here is an overview of what’s in train relating to: paid parental leave; award modernisation; the proposed National Employment Standards (NES); and the privacy law review.

Paid parental leave inquiry

The timetable for the inquiry is as follows:

  • Release of Issues paper: April 2008
  • Initial public hearings: May 2008
  • Initial submissions due: 2 June 2008
  • Release of Draft Report: September 2008
  • Public hearings for Draft Report: Late November 2008
  • Final Report: 28 February 2009

Award modernisation

On 1 April 2008, the President of the AIRC formally received the modernisation request from the Minister to commence  the process of award modernisation. The request states that the Commission is to complete the award modernisation process by 31 December 2009.

The AIRC is under a firm timeframe to have completed by 30 June 2008: 

  1. a list of priority industries/occupations for award modernisation
  2. a timetable for completing award modernisation
  3. a model flexibility clause for awards.

National Employment Standards (NES) proposed

Submissions on the proposed NES closed on 4 April. A list of submissions with links to those submissions not designated as confidential are available at the Workplace Publications webpage.

Privacy Review - report deadline extended

The Australian Law Reform Commission (ALRC) was due to provide the Government with its final report on its extensive review of the Privacy Act last month.

The Government has extended this reporting date to 30 May 2008. The report is important for employers because the Commission had previously recommended that the small business exemption and the employee records exemption should be removed.
