Latest WorkChoices amendments receive assent

The majority of the amendments in the Workplace Relations Legislation Amendment (Independent Contractors) Act 2006 commence the day after assent - i.e. 12 December 2006. However, some of the amendments have retrospective effect and are taken to have applied from 27 March 2006. The details are still being worked out in relation to retrospectivity (See previous article.)

Independent contractors legislation

The Independent Contractors Act 2006 (the IC Act) also received royal assent on 11 December 2006, however the IC Act will commence on a day to be fixed by proclamation, or within six months of Royal Assent.

It is likely that the Government will allow a period to time for industry to be informed of these new laws, prior to proclamation and its commencement. The Minister for Employment and Workplace Relations has indicated that the IC Act is expected to commence from a date to be determined during the first quarter of 2007.
