The Federal Government introduced into the House of Representatives the Fair Work Amendment (Transfer of Business) Bill 2012 on 11 October 2012.
The Bill provides that where there is a transfer of business from a state public sector employer to a national system employer, employees will retain the benefit of their existing industrial instrument and accrued entitlements, and have their prior service recognised. This follows proposals announced by the Hon Bill Shorten MP in the wake of state public sector restructures. The Bill and Explanatory Memorandum are available on the
Parliamentary Business webpage.
