Modern awards and NES commence 1 January 2010

With the introduction of modern awards and the National Employment Standard from 1 January 2010, Australia’s industrial relations system for private industry will undergo a major transformation.

With the introduction of modern awards and the National Employment Standard (NES) from 1 January 2010, Australia’s industrial relations system for private industry will undergo a major transformation.
 
All employees of national system employers will come within the scope of the NES and modern awards will progressively replace numerous other industrial instruments that have applied to Australia’s workforce. It’s not an immediate change to modern awards in certain respects because transitional provisions are applicable — particularly relating to wage rates. In addition, unincorporated employers will have a grace period until 1 January 2011 to move to the new awards.
 
Which modern award applies?
 
Because thousands of ‘old’ awards are being replaced by modern awards, both employers and employees need to identify the relevant modern award(s) applying to them. The AIRC has provided a draft comparative table (Draft awards audit by modern awards) to assist this exercise. If spreadsheet fails to open, follow these steps:
  1. Go to the Award Modernisation webpage.
  2. From the Downloadable list, click the link Draft Awards Audit by Modern Awards. 
  3. When this document starts to load, select Click Here for Options from the top navigation bar and then Open from the dialogue box.
