Penalty rates decision tipped for September

The Fair Work Commission's decision on penalty rates is likely to be handed down in September, according to the Australian Chamber of Commerce and Industry.

September 13 is the latest date for the Fair Work Commission to deliver its decision on penalty rates if it is to meet its own timeliness benchmark, according to the Australian Chamber of Commerce and Industry.

The commission has yet to confirm the timing of the release of its decision. But under its self-imposed benchmarks about the timing of the handing down of decisions, 90 per cent of all reserved decisions are to be delivered within eight weeks and 100 per cent within 12 weeks.

The measure begins from the final day of the last hearing or the date of receipt of the last written submission, whichever is later.

The penalty rates hearings concluded in April and submissions were lodged up to June 21.
