Legislation covering the holiday on 7 September for businesses in designated parts of Sydney is progressing through NSW Parliament. WorkChoices effectively grants the day as a holiday to those employees coming within the terms of the gazettal.

The explanatory memorandum notes:

'Friday, 7 September 2007 has been appointed as a public holiday in certain local government areas of metropolitan Sydney to facilitate the holding of an Asia-Pacific Economic Cooperation (APEC) meeting in Sydney on that day …'

Public holidays/Bank Holidays legislation is also amended to provide that 7 September is a holiday in the nominated areas.

WorkChoices legislation grants the entitlement to be paid ordinary pay for the day, to those employees within the nominated areas. To decide whether additional payments are due, the particular award or agreement would have to be checked.

Federal instruments that pick up localised State public holidays in particular State localities could refer to this NSW legislation as a source for the entitlement.

Award-free employees are entitled to public holidays under WorkChoices.

Designated areas

Local council areas affected are: Ashfield, Auburn, Bankstown, Baulkham Hills, Blacktown, Botany Bay, Burwood, Camden, Campbelltown, Canada Bay, Canterbury, Fairfield, Holroyd, Hornsby, Hunters Hill, Hurstville, Kogarah, Ku-ring-gai, Lane Cove, Leichhardt, Liverpool, Manly, Marrickville, Mosman, North Sydney, Parramatta, Penrith, Pittwater, Randwick, Rockdale, Ryde, Strathfield, Sydney, Sutherland, Warringah, Waverley, Willoughby, and Woollahra.
