Annual indexation of remuneration and compensation limits

Regulation 30BF of the Workplace Relations Regulations 1996 provides for the annual indexation of the amounts referred to in ../http://www.austlii.edu.au/au/legis/cth/consol_act/wra1996220/s170cc.htmlsections 170CC(3)(b), ../http://www.austlii.edu.au/au/legis/cth/consol_act/wra1996220/s170cc.html170CC(4)(b) and ../http://www.austlii.edu.au/au/legis/cth/consol_act/wra1996220/s170ch.html170CH(9)(b) of the ../http://www.austlii.edu.au/au/legis/cth/consol_act/wra1996220/Workplace Relations Act 1996. The provisions in ../http://www.austlii.edu.au/au/legis/cth/consol_act/wra1996220/s170cc.htmlsections 170CC(3)(b) and ../http://www.austlii.edu.au/au/legis/cth/consol_act/wra1996220/s170cc.html170CC(4)(b) exclude non-award employees from the Commission's unfair dismissal jurisdiction if their rate of remuneration immediately before termination exceeds the specified rate. The specified rate as of 1 July 2000 is $71,200.

Regulation 30BF of the Workplace Relations Regulations 1996 provides for the annual indexation of the amounts referred to in sections 170CC(3)(b), 170CC(4)(b) and 170CH(9)(b) of the Workplace Relations Act 1996. The provisions in sections 170CC(3)(b) and 170CC(4)(b) exclude non-award employees from the Commission's unfair dismissal jurisdiction if their rate of remuneration immediately before termination exceeds the specified rate. The specified rate as of 1 July 2000 is $71,200.

Section 170CH(9)(b) provides that in considering the remedy for an unfair dismissal, the Commission may order the employer to pay the employee an amount in lieu of reinstatement. For non-award employees this amount cannot exceed $35,600 (half of $71,200 ie six months pay).

The application of these new remuneration and compensation limits is for terminations on or after 1 July 2000.
