Shift penalties are included in the definition of a "week’s pay" in determining redundancy payments, a Full Bench of the NSW Industrial Relations Commission has held. The matter had been referred to a Full Bench from Justice Maidment, who was hearing an application for a redundancy award covering private sector nurses.(Industrial Relations Act 1988) [NURSES' PRIVATE HOSPITALS REDUNDANCY (STATE) AWARD [1995] NSWIRComm 234(20 December 1995)] {NURSING HOMES & PRIVATE HOSP EMPS REDUNDANCY (STATE) AWARD[1997] NSWIRComm 99(22 July 1997)} Industrial Relations Act 1996

The NSW Private Hospitals Association wanted shift penalties excluded from the definition of a "week’s pay", whilst the NSW’s Nurses Association wanted a comprehensive clause. The Full Bench defined the term broadly, rolling in overaward payments, higher duties, industry allowances, and a range of other allowances.
